I need help I just broke up with my boyfriend but we have a dog together how can I get the dog back?

It’s a long story but hear I go. My ex and I were together for 6 years , we just got the dog from a friend when he was 6 months old. At that time we were living at his dads house. His dad kicked him out so I moved in with my parents and he moved in with his mom. His mom wouldn’t let him stay with him so I took him. Growing up we never had dogs in our house but Chopper is an inside dog and my parents said yes to him living there. I paid for all of his shots and medical bills. At the vets offices he is in my name not my ex’s. My family has paid for his food, toys, treats, and he hasn’t really paid for much at all except he did train him. I will say my ex trained him very well, and he knows lot of tricks but I want him home with me. My ex says it his dog not mine we just moved back in together last Nov and the dog went with us to the condo but we’ve broken up and are really done and over!! But as I’ve said now he wont let me see the dog or have him, what do I do. I dont want a new dog

It is very hard to prove ownership of a dog. The only legal way to do this is to file a claim in small claims court. To help prove possession get the vet bills and if he has a rabies shot and it is registered in your name then bring that too. You will have to pay a court filing fee (probably about 60 bucks). Hopefully your ex won’t show up to court and then you can get a default ruling and have the police help you execute it. Oh and you DO NOT need a lawyer for small claims court. It is very laid back like arbitration. As the person above said a dog is considered property.

A great way (in the future) to help prove possession is to have your dog microchiped and registered to you. We did this after hurricane Katrina.

Of course there are otherway like stealing him back but the above would be your remedy in law.
